This Privacy Policy describes how Silent Echo, LLC d/b/a Kaps (“Kaps”) collects, uses, discloses, and protects user information collected via use of Kaps’ website found at https://kaps.fyi/, mobile application, and all services related thereto (collectively, the “Service(s)”).
Any information you provide through your use of the Services is subject to the terms of this Privacy Policy, as may be updated by Kaps from time to time. Please read this Privacy Policy carefully before using and/or accessing the Services. This Privacy Policy does not apply to any third-party websites, services, providers, or applications, even if such are available or accessible through our Services.
If you do not agree with this Privacy Policy, please do not use or access the Services.
Information We Collect
User Information: When you register an account and/or otherwise use the Services, Kaps may collect the following information:
- Your name;
- Your email address;
- Your username;
- Your phone number;
- Your date of birth;
- Your billing/payment method information;
- Your residential address;
- Your location;
- Identity verification information (including, but not limited to, biometric data); and/or
- Any other information you submit to Kaps.
You agree that all information you provide in using the Services shall be accurate, complete, and up-to-date. It shall be your sole responsibility to update any and all information provided for use of the Services.
Additional Information Collected by Kaps or Third Parties: When you access the Services, additional information may be automatically collected by Kaps or third parties on our behalf for tracking and/or other business purposes. Such information may include:

- Your IP (Internet Protocol) address;
- Your device and/or usage data;
- Information regarding your use of the Services (e.g., pages viewed, the amount of time spent on particular pages, purchase history, transaction data, etc.); and/or

We may also disclose aggregated and/or de-identified user statistics and other metrics related to our Services in order to describe our products or services to current and prospective business partners and to other third parties for other lawful purposes.

Kaps may use the information we collect for one of the following reasons:
- To verify your eligibility to use the Services and/or identify you as an account owner;
- Administrative purposes;
- To process transactions;
- To respond to customer service reports;
- To alert users to new products, content and/or features;

Kaps does not trade, sell, or otherwise share your personally-identifiable information with third-parties except as set out in this Privacy Policy. We use best commercial efforts to ensure that third parties with whom your personally-identifiable information is shared do not use your personally-identifiable information for any purpose other than those specified by us or otherwise required by law. Notwithstanding, Kaps may share your information for any of the following reasons:
Fulfilling Purchases, Transactions, and Other Services: We may share your personal information for the purpose of processing payments and/or other transactions, conducting testing, locating users, personalizing and improving your use and experience of the Services, sending emails and push notifications, providing customer support, and preventing harmful and/or unlawful uses of the Services.
Business Transfers: We may share your personal information if Kaps is involved in a merger, acquisition, sale, bankruptcy, or other reorganization (e.g. insolvency, reorganization, or any other transaction changing either ownership or control of the company). You acknowledge and agree that Kaps has no control over how such information is treated, transferred, or protected by such third parties.
Related Companies: We may share and disclose your personal information with any subsidiary, affiliated company, or member of our company group.
Agents, Consultants and Related Third Parties: We may share your information with our business partners, suppliers, and/or subcontractors as necessary in order for them to provide services, such as financial transactions or verification of your identity.
Advertisers and Analytics: We may disclose information to advertisers and/or advertising networks that require the data to select and serve relevant advertisements to you and/or others. We do not disclose personally identifiable information about individuals to our advertisers, but we may provide them with de-identified and/or aggregated information about our users. Legal Requirements: We may disclose your information: (a) with our accountants, attorneys, and/or other professional advisors who owe a duty of confidentiality to Kaps, (b) as required by applicable AML/KYC regulations and/or other third party obligations imposed upon Kaps relating to your use of the Services, and/or (c) if required to do so by law or if we have a good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Kaps, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
Accessing, Modifying or Deleting Your Information
You can access and update certain personal information that Kaps holds about you by logging into your account. You can also request changes by emailing us at support@kaps.fyi. You may request deletion of certain personal information maintained by us, and we will make all reasonable efforts to honor your request. Please note that we may be legally required to keep certain information for a certain period of time (in which case we will comply with your deletion request only after we have fulfilled such requirements). Deletion requests may be made by emailing us at support@kaps.fyi.
Security
Kaps takes reasonable security measures to protect the information that we collect from unauthorized access, use or disclosure. Notwithstanding, we cannot guarantee that any third party with whom we share information will comply with its obligations regarding such information. Furthermore, even though appropriate measures are used to prevent unauthorized disclosure of information, we cannot assure you that any information collected or received by us will never be disclosed in a manner that is inconsistent with this Privacy Policy, and do not accept liability for any unintentional disclosure.
You agree that we may communicate with you electronically regarding security, privacy, and/or administrative issues regarding your use of the Services. If we learn of a security system’s breach, we shall notify you electronically by posting a notice on the Website or sending an email to the email associated with your account.
Third Party Payment Provider
When you make a purchase and/or request a transaction, Kaps may process your request through a third-party payment processor. The third-party payment processor may collect certain financial information from you, including your billing information. In order to delete your payment method or billing information, you may need to do so with the third-party payment processor.
Retaining Your Information
Kaps will retain your information while you are an active user of the Services, and for as long as needed thereafter in accordance with applicable law. Before we use any of your personal information for any new purpose not originally authorized by you or otherwise set forth in this Privacy Policy, we will use best efforts to provide details regarding the new purpose and give you the opportunity to opt-out.
Opt-Out
We may send you marketing communications or emails that contain information about our products and services, or information about upcoming features. You may opt out of receiving such notifications by making necessary changes as made available via your account. You can also unsubscribe from such communications by emailing us at support@kaps.fyi. Notwithstanding, you will not be able to opt-out of certain administrative communications regarding the Services – e.g., communications regarding updates to our Terms and Conditions or this Privacy Policy.
Your Privacy Rights
The following rights may be exercised directly by you or, in certain cases, through an authorized agent:
- You have the right to request information about the categories and sources of information we collect, our purposes for collecting the information, and how it is used. Details about our data collection, use and third-party disclosures can be found in this Privacy Policy. In addition, you have the right to request a copy of your personal information.
- You have the right to request that we correct and/or delete some or all of the personal information that we have about you, subject to certain exceptions (i.e. information used to provide features on the Website, complete transactions, honor opt-outs, prevent fraud, spam, and other abuse, comply with our legal obligations, cooperate with law enforcement, and/or to exercise and defend our rights).
- You have the right to opt out of the sale of your personal information, and to request information about whether we have sold your personal information in the past twelve (12) months. We do not sell personal information. Should such change, we will notify users and provide an ability to opt-out as required.
- You have the right to request that we limit use and disclosure of your personal information to uses necessary to provide the Services, comply with legal obligations, or as otherwise permitted by applicable law(s).

In order to respond to your request(s), we must be able to verify your identity as the owner of the account and/or personal information you are inquiring about. We may verify identity by confirming that you are the owner of the email address associated with the account to which the personal information is associated. An authorized agent submitting a request on your behalf must also have access to the email address associated with the account, along with sufficient evidence (as determined in Kaps’ sole discretion) that you have authorized that person to submit the request on your behalf. Kaps does not discriminate against anyone because they exercise any rights herein.
Children’s Policy
The Services are not directed toward individuals under the age of 18 (or the age of majority in the jurisdiction from which they access the Services) and we do not knowingly collect information from individuals under the age of 18 (or the age of majority in the jurisdiction from which they access the Services). If you are under the age of 18 (or the age of majority in the jurisdiction from which you access the Services), please do not submit any information through the Services. If we become aware that we have collected personal information from individuals under the age of 18 (or the age of majority in the jurisdiction from which you access the Services), we will take reasonable steps to delete it as soon as practicable.

The Services may contain links to other websites not operated or controlled by Kaps (the “Third Party Websites”). Additionally, Kaps may make its Services available through Third Party Websites. Kaps is not responsible for the actions of any Third Party Website(s). This Privacy Policy does not apply to Third Party Websites and links to or from the Services do not imply that Kaps endorses or has reviewed the Third Party Website(s). This Privacy Policy does not cover any collection or use of information that any Third Party Website(s) may collect from you, or the practices used by Third Party Websites to collect such information. If you decide to use, click on, access, or provide any personal information to any Third Party Website(s), you acknowledge that you are doing so at your own risk.
Terms and Conditions
Your use of the Services is subject to our Terms and Conditions. This Privacy Policy incorporates all terms set forth in our Terms and Conditions. The provisions contained in this Privacy Policy shall survive any termination of your account and/or use of the Services.
Changes to Privacy Policy
Kaps reserves the right to make changes to this Privacy Policy from time to time. If a revision to this Privacy Policy is made, we will communicate any such change via the email address associated with your account. Such changes shall go into effect as of the “Last Updated” date provided above. Your continued use of the Services after any changes to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
Governing Law
This Privacy Policy shall be construed and enforced in accordance with the laws of the State of Delaware, without regard to any conflict of law provisions. Notwithstanding the foregoing, this Privacy Policy, and the collection of information hereunder, shall comply with all relevant data protection provisions, including, without limitation, the Data Protection Act, General Data Protection Regulation, the California Consumer Privacy Act (“CCPA”) (as amended by the California Privacy Rights Act (“CPRA”), the Virginia Consumer Data Protection Act (“VCDPA”), and/or any other applicable act or regulation governing our use and/or collection of your Personal Information.
Any dispute regarding the terms of this Privacy Policy shall be resolved in accordance with the terms of the “Arbitration Agreement,” set forth in the Terms and Conditions.
